Terms of Service

These Terms of Service are a binding agreement between you and Aivagazina. By creating an account or purchasing credits you agree to be bound by them.
1. The service
Aivagazina provides a suite of AI-powered pet care assistants (Health Advisor, Nutrition Planner and others) that are accessed by spending credits.
The service is informational only. It is not a substitute for professional veterinary care. In an emergency, contact a licensed veterinarian immediately.
2. Accounts
You must be at least 18 years old and able to enter into a binding contract to purchase credits.
You are responsible for keeping your login credentials confidential and for any activity under your account.
Provide accurate account information and keep it up to date.
3. Credits
One credit equals €0.10 (or its equivalent in the currency you selected at checkout using our reference exchange rate).
The minimum purchase is 50 credits.
Credits are non-transferable and are consumed each time you use an AI tool at the published credit cost.
Credits have no cash value except as described in our Refund Policy.
4. Payments
Bank transfer is currently the only active payment method. Card, PayPal and Stripe options are announced but not yet available.
Credits are added to your balance after we receive and confirm your payment.
Prices shown include VAT where applicable. We charge and remit VAT in accordance with EU rules for digital services.
5. Acceptable use
You agree to use the service in accordance with our Acceptable Use Policy.
We may suspend or terminate accounts that violate these terms.
6. Intellectual property
The Aivagazina platform, brand and content are owned by Aivagazina or its licensors.
AI outputs generated for you may be used for your personal pet care needs.
7. Disclaimers
The service is provided "as is" without warranties of any kind.
AI outputs may contain errors and must not be relied on as medical advice.
8. Limitation of liability
To the maximum extent permitted by law, Aivagazina's total liability is limited to the amount you paid us in the 12 months preceding the claim.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by applicable law, including liability towards consumers for death, personal injury, gross negligence or wilful misconduct.
9. Changes
We may update these terms. Material changes will be communicated by email or an in-app notice at least 14 days before they take effect.
10. Account termination
You may close your account at any time by writing to [email protected].
When an account is closed, unused credits remain refundable under our Refund Policy: we refund the value of unused credits at the original purchase rate, minus transaction fees actually incurred, provided the request is made at the time of closure or within 12 months afterwards.
Credits granted for free through promotions or gifts expire on closure and are not refundable.
We may terminate or suspend an account for a serious or repeated breach of these Terms; in that case unused paid credits are still refunded unless the breach involved fraud or abuse of the service.
11. Governing law and jurisdiction
These Terms and any dispute arising from them are governed by Polish law.
If you are a consumer, this choice of law does not deprive you of the mandatory protections available to you under the law of your country of residence, and you may bring proceedings before the courts of that country.
12. Complaints procedure
Send complaints to [email protected] with your order reference and a description of the issue.
We confirm receipt without undue delay and provide a substantive answer within 14 days.
If we do not answer within 14 days, the complaint is deemed accepted as submitted.
13. Out-of-court dispute resolution
Consumers in the EU may use the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr to submit a dispute about an online purchase.
Consumers in Poland may also seek free assistance from a municipal or district consumer ombudsman (rzecznik konsumentów) or from the Trade Inspection (Inspekcja Handlowa) mediation and arbitration procedures.
We are not obliged to participate in an out-of-court procedure, but we will consider each request in good faith.
